Financial proceedings arising from divorce, nullity or judicial separation, including complex financial cases and those with international aspects

We are specialists in dealing with all aspects of financial proceedings arising from divorce, dissolution, nullity or judicial separation.  Whether it is negotiating outside of court or representing you robustly in court to secure the best possible outcome for you. Much of our work has an international element and with the majority of the partners at AFP being members of the IAFL (International Academy of Family Lawyers) we are best placed to deal with complex situations which may involve trusts (often located offshore) and tax issues.

Financial agreements on separation without divorce

For some couples, divorce may not be the right option for practical or religious reasons.   People who are already married or in a civil partnership can enter into a written agreement setting out what they intend to happen to their money, property and other practical issues as a consequence of their current or planned separation.  We can prepare a Separation Agreement on your behalf.

Property disputes between cohabiting couples on separation

Many cohabiting couples do not realise that there is no such thing as a “common-law spouse”. Unmarried couples do not acquire the rights and responsibilities of a married couple by virtue of living together for a certain period of time. This means that cohabitating couples who are separating are forced to rely on Trust and Property Law to resolve their disputes. We can guide you through this process and protect your best interests at every stage.

Investigation of trusts, privately owned companies and pension assets

We have extensive experience in dealing with complex financial situations, often involving trust, tax and corporate structures. It may be important to protect your family’s assets or to prevent or trace family fund and we will act quickly to ensure your position is protected. We understand and deal with these assets on a daily basis to secure the best result.
Pensions can often be one of the most valuable assets on separation and how best to deal with them will depend on your individual circumstances. We can advise on you on this complex area and we work closely with actuaries and accountants where appropriate.
